Hawk Rent A Car Malaysia Rental Terms for travel between 01-Apr-2017 and 31-Mar-2019
An initial, non-refundable deposit will be secured at the time of booking confirmation. Accepted credit cards are Visa and MasterCard.
The balance is to be paid directly to the supplier on arrival.
HAWK accepts all major credit / charge cards, which will need to be presented at the time of vehicle pick-up.
HAWK reserves the right to request for an additional amount over and above the estimated rental cost to cover against miscellaneous costs that may arise from the rental.
Cash rentals and debit cards are not accepted.
STANDARD RENTAL QUALIFICATION
The Hirer must meet the standard car hire rental agreement terms and conditions. (A copy is attached). Failure to meet the standard terms and conditions of a rental will result in refusal of rental. The hirer will be bound by the laws governing the Hire of the vehicle and any contravention of local laws; will result in fines by the authorities concerned to the hirer.
VEHICLE MAKE AND MODEL
Vehicle makes and models are correct at the time of publishing these terms. The company reserves the right to vary the make and model of the vehicle but will make every effort to honor specific car model requests. Bookings will only be confirmed by group and not by vehicle type. All vehicles are air conditioned and fitted with radio / CD. Cars may be collected from any Hawk rental station and may be returned to another Hawk rental station within Peninsular Malaysia, subject to Inter-City charges.
Please take note that Reservations will be confirmed by vehicle group / category only and not by a particular vehicle make or model within the group. However, every effort will be made to provide a client with a preferred model / type as requested, subject to availability.
Rates include coverage of USD1 million @ RM3 million for third party damage, unlimited for third party death or bodily injury. The hirer is obliged to promptly report any accident, theft or vandalism involving the hired vehicle to a Hawk Office and a police report lodged pertaining to the accident within 24 hours. Failure to comply with the above requirement will void all liability protection for damages, and the Hirer may be charged the full cost of damage incurred on the vehicle.
INSURANCE EXCESS on the vehicles will be as given below :-

Inclusion of Collision Damage Waiver (CDW) into the rate or acceptance of CDW by the Hirer will limit the Hirer’s responsibility to the above NON WAIVABLE EXCESS (“NWE”). However, if the accident was a “Single Accident” defined as no third party being involved, the Hirer’s responsibility will be for the full cost of repair. (In the event of the Hirer being found to be under the influence of alcohol or any intoxicating substance, all damage cost incurred will be the full responsibility of the Hirer.)
Missing items or accessories are NOT PROTECTED by our insurance or by purchase of CDW and / or SCDW, will be the responsibility of the Hirer, i.e. Radio Cassette, Hubcaps, CD, Tools or any other accessory fitted on the vehicle.
PERSONAL ACCIDENT INSURANCE (“PAI”)
PERSONAL ACCIDENT INSURANCE (PAI) provides coverage of RM125, 000.00 (One Hundred & Twenty Five thousand) and the rate is as follows :- (not included in the rates)

The coverage is extended for injuries sustained inside or outside the vehicle, during the agreed period of the hire, as indicated on the rental agreement for the Hirer. The Cover is for the Hirer and a maximum of 5 (five) passengers for saloon vehicles and 7 (seven) passengers for MPV’s.
Protection is only valid for the agreed period of Hire as indicated on the rental agreement. An extension of rental must be authorized by Hawk, failing which the “PAI” cover will not be valid.
CALCULATION OF RENTAL
Car hire charges billed to the Agent will cover only the period stated on the agent's Reservations Advice/MCO/Voucher. The calculation of the rental period will be based on the rate chart given on page 2. Billing will include all items as indicated on the Agent’s Advice/MCO/Voucher. All other charges not mentioned will be collected directly from the hirer.
The rates are charged on a 24 hours basis, and should the rental at the time of return incur excess hours, the charge will be at 1/5th of the applicable rate. For each completed hour, the 1/5th pro-rated charge will be applied. Return after the 5th hour will incur the client an additional day’s charge.
The rate on the “Excess days” will apply if the hirer wants to extend the rental period from the original booking advice given from Agent. Payment of the Excess days will be borne by the hirer unless stated otherwise by the Agent. The excess day will be computed based on standard tariff less 30%.
COLLISION DAMAGE WAIVER
The Hirer will be responsible for any damage of any nature caused to the vehicle up to Excess Amount as tabulated in the table on page 4 and 5. However, if damage to the vehicle is caused by the recklessness of the Hire, when damage is caused by the Hirer being under the influence of alcohol / drugs, then the Hirer will be responsible for the entire cost of the damage. Any loss of the Accessories / Parts in the vehicle will be the responsibility of the Hirer.
HAWK guarantees a replacement vehicle should the need arise, of similar engine capacity from the nearest rental station, within a period of 1 hour of any Hawk Station and within 2-3 hours if the vehicles is at a Non Hawk City or Town, depending on distance and time of the day. No replacement vehicle will be provided after 2200 hrs. In such instances, the replacement vehicle will be delivered the next morning.
A refueling service surcharge USD 5.00 (RM15.00) will be levied for vehicles returning with less gasoline than when originally rented out. All vehicles are rented with a full tank and should be returned with a full tank. Only unleaded RON95 gasoline must be used.
A deposit of USD 134.00 (RM400.00) is payable to Hawk upon collection of the vehicle. The deposit will be refunded upon return of the vehicle, less any monies due to Hawk.
DRIVER’S LICENCE AND AGE
The Hirer and any additional driver must be a minimum of 23 years of age, with a valid driving license (an International driving permit / license is preferred) which is at least 2 years in force, recognized and valid within Malaysia. However, the company reserves the right to decline rental to any person who is deemed physically unfit to drive.
PARKING AND TRAFFIC FINES
All parking fees and traffic fines will be the responsibility of the Hirer. By signing the Rental Agreement and the traffic and / or parking fines / summons form, the Hirer agrees to accept all charges pertaining to traffic and / or parking fines / summons. [Charges invoiced or directed to a credit card for traffic fines / summons will include a USD 17.00 (RM50.00) administrative fee].
BABY SEAT / INFANT SEAT / CHILD SEAT / BOOSTER SEAT
Baby seats are available on request and such request must be made at the time of confirming the reservation. A surcharge of USD 6.00 (RM16.00) per day or a maximum charge of USD 20.00 (RM60.00) per rental (Inclusive of 6% tax)
A hirer may return or drop off a rental vehicle to another city within Peninsular Malaysia, and will incur a minimum charge of USD 45.00 drop off fee, so long as the vehicle returns within working hours of the station. Any returns outside the working hours 18:01 - 22:00 will incur a drop-off or inter-city return fee of USD 55.00. In towns or cities where HAWK is not represented, a re-positioning fee will be levied to bring the vehicle back to the nearest HAWK Station (see Delivery & Collection Chart). Vehicles rented from HAWK Subang or KL City and wanting to return to KL International Airport will incur an Airport return charge of USD 28.00 between the hours of 08:00 to 18:00 hours. For returns of vehicle after hours 18:01-22:00, the charge will be at USD 38.00(tax applies).
DELIVERY AND COLLECTION CHARGES
Any vehicle delivered or collected from a location other than a HAWK Office will incur a delivery and / or collection charge, depending on the distance and time of the day. For delivery and / or collection to towns where HAWK is not present, the charges will be as given based on normal business hours of 0800 – 1700 (Monday – Saturday).
Sundays and Public Holidays, will also incur an additional surcharge.
Waiting Fee (After Office hours charges)
1. No surcharge applicable for pick up/return to our rental locations during office hours. (Please refer to Hawk Rental Network)
2. The late pickup/ drop off fee at all our rental stations from 06:00 to 08:00 hours will incur a fee of USD 25.00 and if after office hours from 18:00 to 22:00 hours will incur a cost of USD 38.00. HAWK will not entertain pickup/ drop-off after 22:01 hours. (Tax applies)
3. At the following rental locations, we have a Key Drop Box at our counter. Customer can drop off the vehicle key outside office hours:-

Note : The surcharge only applies to those rental locations as not mentioned in (Point 3) above.
EXTENSION OF RENTAL
Should the Hirer wish to extend the rental, it is important that the renting station be advised immediately and the required additional rental deposit paid, so that the insurance cover is extended to cover the additional days. Failure to do so may mean that the Hirer is driving the vehicle without any insurance coverage and is in effect unauthorized to be in possession of the vehicle. Hawk reserves the right to repossess the vehicle from the Hirer without any notice given to the Hirer.
CANCELLATION / NO SHOW
In the event of cancellation the initial deposit paid remains non-refundable.
Cancellation received less than 24 hours before the pick-up date or NO SHOW will incur a cancellation fee of USD 25.00(Tax inclusive)
ADDITIONAL DRIVER’S FEE
A fee of USD2.00 (RM6.00) per additional driver per rental day will be charged. A flat rate of USD6.00 (RM 18.00) per rental if more than 3 additional drivers, irrespective of rental length. All fees mentioned above are inclusive of GST.
GPS Equipment is available for rental at USD 10.00 (RM 30.00) per day and USD 60.00 (RM180.00) per maximum rental. Loss or damage to this equipment will incur a penalty charge of USD 170.00 (RM500.00).
(*Note that some vehicle models come with factory fitted GPS navigation. The charge for the use of this item will be the same.)
Hirers are not permitted to drive the vehicle into THAILAND, SINGAPORE, INDONESIA and BRUNEI. However, should a vehicle enter SINGAPORE the Hirer will be fully liable and responsible for all fees and fines as imposed by the Land Transport Authority (LTA) of Singapore and HAWK reserves the right to charge any fines or compound charges resulting from any non-compliance of the road transport rules of Singapore to the hirer. A vehicle returned in Singapore will incur a repositioning fee of USD 138.00 (RM400.00).
ROADSIDE / EMERGENCY ASSISTANCE
In the event of a breakdown, mechanical failure of the vehicle or an accident, which requires the services of a repairer, permission must first be obtained from HAWK, before proceeding to carry out any repair, or purchase of parts.
All rentals are subject to a 6% Government Service Tax, (Details of the above are available at the rental counter)
TERMINATION OF CONTRACT Hawk reserves the right to terminate the Contract, providing the Agent a 14 days’ notice, should the Agent fail to observe any one of the following:
I. Failure to make payments due to Hawk within the agreed credit period.
II. Bringing Hawk to disrepute in any manner with the clientele or any foreign party.
III. Non observance of the agreed terms and conditions
Vehicles returning to an Airport location will incur an additional USD 10.00 (MYR 30.00).
Note : If the vehicle is returned before or after the hours of 0800 to 1700 hrs (Monday to Sunday) the Hirer will be charged an additional USD 12.00 (RM35.00) up to 2200 hrs. After 2200 hrs the surcharge will be USD 22.00 (RM65.00), in addition to the charges as tabulated in the above table. No collection or delivery will be entertained after 12 mid night.
Terms of booking on this website
The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:

To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
